Legal Issues and Arrest History
On December 23, 2021, Kay Flock turned himself into police after being identified as the main suspect in a shooting. He was arrested for allegedly shooting and killing Oscar Hernandez (also referred to as Hwascar Hernandez in some reports), a 24-year-old man, outside a barber shop in Harlem, New York, on December 16, 2021.
According to the NYPD, Kay Flock walked past a barber shop when the victim ran out, at which point they claim he shot Hernandez in the neck and back. Hernandez died at Mount Sinai Hospital.
Kay Flock has been represented by Jeffrey Lichtman, the attorney known for representing Joaquin “El Chapo” Guzman. Lichtman has maintained that Kay Flock acted in self-defense, pointing to surveillance footage that allegedly supported his client’s innocence.
In February 2023, Kay Flock was indicted on RICO charges alongside seven other defendants in a federal racketeering case. Authorities accused the group of involvement in numerous violent crimes that occurred in the Bronx between 2020 and 2022, including multiple shootings. According to court documents, all other defendants agreed to plea deals before the trial began on March 10.
After a 10-day trial in 2025, Kay Flock was found guilty on four counts: racketeering conspiracy, use of a firearm resulting in death, attempted murder and assault with a dangerous weapon in aid of racketeering, and use of a firearm for attempted murder and assault with a dangerous weapon. However, in a notable development, jurors acquitted him on the charge of murder in aid of racketeering related to the 2021 killing of Hernandez.
During the trial, prosecutors controversially used Kay Flock’s music and lyrics as evidence, specifically highlighting his music video “Who Really Bugging,” which they claimed referenced a real-life shooting incident. The defense team characterized this approach as an unfair attack on drill rap.
Kay Flock is scheduled for sentencing on July 16, 2025, where he could receive between 20 years and life in prison. Had he been convicted on all counts, including the murder charge, he would have faced a mandatory life sentence.
